New York has no-fault accident liability laws that cover all traffic accidents. This includes accidents that involve pedestrians. Pedestrians who are injured can file for no-fault benefits, which cover medical expenses and will pay a portion of lost wages. However, when a person’s injuries exceed $50,000, that pedestrian may then file a civil lawsuit against the driver. The law also allows for a pedestrian to file a lawsuit if they can prove that they suffered significant disfigurement, dismemberment, fractures, loss of a fetus, permanent loss of a bodily organ, member, function, or system, or other medically determined injury which prevents the person from performing daily tasks.

The New York Daily News reports that a New York girl has won a $43 million lawsuit against the Brooklyn bus who plowed into her as she crossed the street.
On Wednesday, a jury awarded an 11-year-old Brooklyn girl $43 million for the massive injuries inflicted upon her when she was hit by a school bus.
The verdict was handed down in the Brooklyn Supreme Court in the civil suit against the school that owns the bus and employed the bus driver, Shneur Brownstein.
The girl was crossing the street at Nostrand Avenue and St. John’s Place in 2017 when a United Lubavitcher Yeshiva School bus slammed into the girl.
The girl, whose name has not been released due to her age, spent a month in Maimonides Hospital recovering from her injuries. Those injuries included two fractured femurs, multiple pelvic and rib fractures, and lung damage.
In addition, the young woman suffered from tears to her urethra that were so extensive it required multiple surgeries. She now requires a catheter to drain urine from her bladder.
The driver of the school bus violated numerous traffic laws, including failure to yield to a pedestrian, when he struck the girl.
