WHEC reports that one person has been arrested after a suspected DWI, rear-end collision in Rochester that injured a woman and a teenager.
The crash took place shortly after 3:00 p.m. on July 4th in the area of Central Park and Seventh Street.
After an investigation, it was determined that an unnamed 24-year-old city woman failed to obey a stop sign. She hit the rear of a vehicle with a 33-year-old woman and a 15-year-old girl inside. The vehicle then hit a tree and overturned.
The woman and the teen were taken to Strong Memorial Hospital with injuries described as minor. The driver of the other vehicle was taken into custody under suspicion of driving while intoxicated. She was not injured.
Names of the persons involved in the crash were not released.
Fortunately, the woman and the girl were not seriously hurt, and fortunately, they visited a doctor to have their injuries documented. New York is one of a handful of states that still has no-fault laws on the books. This means that usually, a driver’s own insurance company reimburses them for damages regardless of which driver is responsible for the crash. However, at times, these benefits are often not enough to cover the medical bills and lost wages incurred by the victim.

New York law also allows the victim to recover damages from the server or seller of the alcohol if it can be proven that the person who caused the injury was “visibly intoxicated” at the time the driver was served the alcohol. Even though the insurance company may reimburse only a portion of damages, evidence can be used to pursue remaining damages in court from parties directly or peripherally involved in the crash.
