Two Injured On A York Fair Ferris Wheel Are Suing The Ride’s Manufacturer
There is no national governing authority to ensure the safety of rides at amusement parks. Instead, inspection is left up to individual states. The state of New York has several inspections to ensure the safety of amusement park rides. The State Department of Labor inspects all the rides at stationary amusement parks at least once per year. Ride operators working at mobile fairs and carnivals must schedule an appointment at least ten days in advance for an inspection to be performed each time the ride moves to a different location. Finally, a ride cannot be operated without a permit from the State Department of Labor. In 2018 alone, the DOL performed 1,734 inspections on 9,170 amusement rides.
Local 21 News reports that two people who were seriously injured on a York Fair ferris wheel are suing the manufacturer of the amusement ride.
The incident occurred at the York Fair last September.
Rider Scott Speicher fell 25 feet after he was ejected from a gondola on the ride according to the lawsuit. Another passenger, Colleen Steffan, was violently tossed around the gondola.
The lawsuit has been filed against Chance Rides Manufacturing, Deggeller Attractions, Inc. The suit was filed with the U.S. Middle District Court.
Both victims are seeking upwards of $75,000 in compensation in the lawsuit according to the filing.
In the lawsuit, the victims allege that the ride was located next to a generator that was too loud, preventing the ride operator from hearing the warning cries of the passengers. An accident report released in October revealed that a loose tie rod caused one of the gondolas to get stuck on its side, causing one rider to fall from its side.
Speicher was left with multiple fractures and Steffan suffered from back injuries due to the accident.
