How Long Do You Have To File a Personal Injury Claim?

If you’ve suffered an injury because of an accident or negligence, you only have a certain amount of time in which to file a claim for compensation. This is called the statute of limitations. In New York, the statute of limitations for a general personal injury claim is three years from the date of the injury. The time frame is the same for car accident, slip and fall, or defective product cases.

There are a few exceptions to this rule for specific types of injury claims:

  • Medical malpractice claims have a statute of limitations of two years and six months.
  • Wrongful death lawsuits have a statute of limitations of two years.

No matter what type of injury you are facing, we highly recommend that you hire a personal injury lawyer as soon as possible. As a general rule, the longer you take to file a claim, the less chance you have of achieving a favorable outcome. Your lawyer will take care of investigating your injury, collecting reports from police or your doctor, and building a strong case to support your claim.

At Friedman & Simon, L.L.P, our Jericho personal injury attorneys take pride in providing high-quality legal services with the compassion and support our clients need. Call us today for a free consultation!

What You Should Do if You Are Injured

If you become injured in an accident or event of someone else’s making, there are several steps you should take to protect and preserve your rights.

First of all, if it is an emergency, contact the police or proper authorities immediately after the accident or event has taken place. The authorities will not only help treat injured parties and secure the scene of the accident, they will also create official documentation of the event.

Second, if you or someone that you are with is able, take photographs of the accident scene. For example, If your accident involves a motor vehicle, secure photos of the damage to all vehicles involved in the accident. If your accident involves a slip or trip and fall, taking photographs of the condition that caused you to fall, will assist in the prosecution of your case.

Third, seek medical attention. Some injuries, such as traumatic brain injury, concussions or internal bleeding, may not be evident until long after the event has taken place. Left untreated, these unnoticed injuries can result in devastating impairment or even death.

Fourth, don’t speak to the insurance company of the person who caused your injuries. Within days of the accident, you may receive a call from a representative of that insurance company who may seek to obtain information or offer you a small amount of money to settle your case. The only insurance company that you are obligated to speak to is your own.

Fifth, be aware that once the negligent person’s insurance company learns that you have been injured they will likely seek information about you on social media. Lastly, call an experienced personal injury attorney at Friedman & Simon, L.L.P. Our attorneys will work to recover the maximum dollar amount of money damages for you.
