Schoharie Family Sues Tire Store That Inspected Limo Before Crash
The Schoharie limousine crash was one of the deadliest road crashes in history. The crash, which occurred on October 6th, 2018, involved a modified 2001 Ford Excursion stretch limousine. It would seat 18 people, which was one more than the number of passengers in the vehicle. The vehicle involved had failed two inspections early that year, including an inspection made the month before the crash. Brake issues were cited in the inspection report and the vehicle should not have been on the road. The vehicle eventually crashed, killing 22 people. All seventeen passengers, the driver, and two pedestrians were killed. The families of the victims have filed several lawsuits.
CBS 6 Albany reports that one of the families is suing Mavis Discount Tire, who performed an inspection on the limo before the catastrophic accident.
The lawsuit was filed on behalf of Shane and Erin McGowan, two newlyweds who were in the limo at the time of the crash.
The 18-page lawsuit, filed in Montgomery Court last Tuesday, cited knowing and willful acts that constituted “gross negligence” against Mavis Discount Tire.
This is the only lawsuit filed against Mavis Discount Tire, which inspected the limousine in May, although it did not have the authority to conduct such an inspection. During a roadside inspection in March, the state Department of Transportation, the vehicle was found to have many violations. The suit goes on to say that Mavis applied temporary fixes to the problems, including fixes to the braking system, which has since been revealed to have failed, causing the accident.
Mavis issued a DMV inspection sticker to the limousine in May. The sticker was issued in spite of numerous defects that were progressively getting worse.
The lawsuit also names the owner of Prestige Limousine for their negligence and misconduct in the registration and inspection process of the limousine.
