New York has a number of laws that govern impaired driving. In addition to driving while intoxicated (DWI), they also have aggravated DWI, and DWAI, also known as driving while your ability is impaired. Driving while your ability is impaired can be charged with a blood-alcohol content from 0.05% to 0.0799%. Another DWAI charge involves driving while under the influence of drugs. The penalties for DWAI can vary depending on whether it’s a person’s first offense or not, but often include fines, jail time, and license suspension. If an accident is involved, the penalties can become more severe and may include having to pay reparations to the injured party.

According to police, Christopher Gomez-Almendarez was traveling westbound in the right lane on the Southern State Parkway. He struck the rear end of a vehicle being driven by 69-year-old Rev. T.C. Mammen. The force of the collision caused Mammen’s vehicle to exit the roadway on the right side and crash into a line of trees.
Rev. Mammen was rushed to St. Joseph’s Hospital, where he eventually succumbed to the injuries he sustained in the accident. Gomez-Almendarez is being charged with second-degree vehicular manslaughter, driving while impaired by drugs, and third-degree assault.
